Terms of Service

These terms cover your use of doctorcandle.com.au and any order you place with us. By using the site or buying from us, you agree to them. Please read them before you order.

In these terms, "we", "us" and "Doctor Candle" mean Doctor Candle. "You" means the person using the site or placing an order.

We are based in Victoria, Australia and sell within Australia.

2. Using This Site

You must be at least 18 years old to buy from us, or have permission from a parent or guardian.

You agree not to use the site for anything unlawful, not to interfere with how it runs, and not to attempt to access parts of it you have no right to access.

We may change, suspend or withdraw any part of the site at any time. We try to keep it available, but we don't guarantee uninterrupted access.

3. Products and Descriptions

We do our best to show our candles and diffusers accurately. Colour, fragrance strength and finish can vary slightly between batches, and screens display colour differently. Small variations are normal in hand-poured products and aren't a fault.

Product availability is not guaranteed. If an item sells out after you order, we'll contact you and refund you in full.

4. Pricing

All prices are in Australian dollars and include GST where applicable. Shipping is calculated at checkout.

We may change prices at any time, but changes won't affect orders we've already accepted.

If a product is listed at the wrong price because of an error, we'll contact you before dispatch. You can confirm the order at the correct price or cancel it for a full refund. We aren't obliged to sell at an incorrect price.

5. Orders

When you place an order you're making an offer to buy. Our order confirmation email acknowledges we've received it, not that we've accepted it. The contract forms when we dispatch your order.

We may decline or cancel an order — for example if the item is unavailable, we can't authorise payment, we suspect fraud, or there's been a pricing error. If we cancel after you've paid, you get a full refund.

6. Payment

Payment is due in full at checkout. We accept the payment methods shown at checkout. Payments are processed by third-party providers under their own terms and security standards. We don't store your full card details.

7. Shipping

Delivery timeframes, costs and tracking are covered in our Shipping Policy, which forms part of these terms.

Delivery estimates are estimates, not guarantees. Once Australia Post has your parcel, transit time is outside our control.

8. Returns and Refunds

Returns, refunds and faulty items are covered in our Refund Policy, which forms part of these terms.

9. Your Rights Under Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You're entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You're also entitled to have the goods repaired or replaced if they aren't of acceptable quality and the failure doesn't amount to a major failure.

Nothing in these terms limits those rights. Our Refund Policy applies in addition to them, not instead of them.

10. Candle Safety

Candles are an open flame. Please use them safely:

• Never leave a burning candle unattended.
• Keep away from children, pets, and anything flammable.
• Burn on a heat-resistant, stable surface.
• Trim the wick to 5mm before each burn.
• Don't burn for more than 4 hours at a time.
• Stop burning when 10mm of wax remains.

Follow the safety instructions on the product and its packaging. To the extent permitted by law, we aren't liable for damage or injury caused by misuse or by ignoring those instructions.

11. Intellectual Property

The Doctor Candle name, logo, product photography, text and site design belong to us or our licensors. You may not copy, reproduce or use them commercially without our written permission.

12. Your Content

If you post a review, photo or comment, you keep ownership of it but grant us a non-exclusive, royalty-free licence to use it in connection with our business, including marketing. You confirm the content is yours to share and isn't unlawful, misleading or offensive. We may remove content at our discretion.

13. Privacy

How we collect and handle your personal information is set out in our Privacy Policy.

14. Third-Party Links

Our site may link to other websites. We don't control them and aren't responsible for their content or practices.

15. Liability

Subject to Section 9 and to the extent permitted by law, our liability for any claim connected with a product or your use of this site is limited to replacing the product or refunding what you paid for it.

To the extent permitted by law, we aren't liable for indirect or consequential loss.

16. Changes to These Terms

We may update these terms from time to time. The version published on this page when you place your order is the version that applies to that order.

17. Governing Law

These terms are governed by the laws of Victoria, Australia. Any dispute will be handled by the courts of Victoria.
